What is a Trademark?

A Trademark is a word, name, symbol, device that distinguishes the identity of a product or service provider from other brands.  Trademarks aid in the promotion of goods and services by identifying their source.  A Trademark is a word, name, symbol or device that is used to distinguish the goods of one person from the goods manufactured or sold by others.  The range of things that are capable of serving as Trademarks are great and includes not just words but also such things as drawings and abstract designs, slogans, distinctive, nonfunctional features of the product itself.

What can be Trademark?

Word Mark:  Trademarks can be applied to words, logos, phrases, shapes, sounds or colors.  They can also include initials and number combinations.

Logos:  may consist of logos used in connection any goods or services.  The design must be inherently distinctive or unique in order to be registered.

Slogans:  A slogan can function as a trademark if it is not merely descriptive or informational.

Color:  Color marks are marks that consis of one or more colors used on particular objects.  Registration of a color mark depends on the manner in which the proposed mark is used.

Sound Marks:  A sound mark identifies and distinguishes a product or service through audio rather than visual means.  Examples of sound marks include: (1) a series of tones or musical notes, with or without and (2) a word or words accompanied by music.
